These Terms & Conditions apply to hosted trips, travel services and other services offered by Special T Travels ("Special T Travels," "we," "us," or "our"). By submitting a trip application, making a payment, confirming a booking, or purchasing a service from Special T Travels, you agree to the terms applicable to that service. 1. Hosted Trip Applications Submitting an application for a Special T Travels hosted trip does not guarantee acceptance or a place on the trip. Applications are reviewed by Special T Travels. We reserve the right to accept or decline an application at our discretion, subject to applicable law. There is no payment required simply to submit an application. If your application is accepted, you will be notified and the required deposit will become due. Your place on the trip is secured only after Special T Travels receives the required deposit. 2. Deposits All hosted-trip deposits are non-refundable, except where Special T Travels cancels the entire trip or a refund is otherwise required by applicable law. The amount of the deposit will be disclosed on the applicable trip page and before payment. Payment of the deposit confirms your booking and indicates your acceptance of the Terms & Conditions, Booking & Payment Terms, Cancellation & Refund Policy and applicable Trip Rules in effect for your booking. 3. Remaining Balance The remaining trip balance must be paid by the final payment date specified for your trip. Special T Travels may agree to a payment plan with a traveller. Unless Special T Travels expressly agrees otherwise in writing, a payment plan does not change the final payment deadline. If the required balance is not received by the final payment deadline, Special T Travels may cancel the booking and release the traveller's place. Amounts previously paid will remain subject to the Cancellation & Refund Policy. 4. Traveller Cancellations All payments made to Special T Travels for a hosted trip are non-refundable if the traveller cancels, except as specifically provided in the Cancellation & Refund Policy or required by applicable law. If a cancelled place is subsequently filled by another traveller, a partial refund may be available under the Cancellation & Refund Policy. Special T Travels has no obligation to advertise, market, resell, transfer or otherwise attempt to fill a cancelled traveller's place. 5. Cancellation by Special T Travels If Special T Travels cancels an entire hosted trip, Special T Travels will refund all amounts that the traveller paid directly to Special T Travels for that trip, including the deposit. Special T Travels' refund obligation is limited to amounts actually received by Special T Travels. Special T Travels is not responsible for reimbursing expenses paid or committed by the traveller to third parties, including airfare, airline fees, separately booked accommodation, ground transportation, visas, passports, vaccinations, insurance premiums, excursions, meals, lost wages or other personal or travel-related expenses, except where otherwise required by applicable law. Travellers are strongly encouraged to obtain appropriate travel insurance and to consider flexible or refundable arrangements for travel components booked independently. 6. Itineraries and Changes Travel inherently involves changing circumstances. Published itineraries represent the planned trip but may be modified when reasonably necessary because of weather, transportation changes, supplier availability, safety considerations, local conditions, event changes or other circumstances. Special T Travels may substitute accommodations, activities, transportation or other itinerary components with reasonably comparable alternatives when necessary. A reasonable itinerary change does not constitute cancellation of the entire trip. 7. Third-Party Suppliers Special T Travels may arrange services provided by independent third parties, including hotels, transportation companies, tour operators, restaurants, activity providers, event organizers and other suppliers. Those suppliers may have their own terms, rules, cancellation policies and liability limitations. To the extent permitted by applicable law, Special T Travels is not responsible for acts, omissions, delays or failures of independent third-party suppliers that are outside Special T Travels' reasonable control. Nothing in these Terms limits rights or remedies that cannot legally be excluded. 8. Airfare and Independent Arrangements Unless expressly stated as included on the applicable trip page, airfare is not included in the price of a Special T Travels hosted trip. Travellers are responsible for arranging and paying for their own flights and other travel components not expressly included in the package. Travellers should not assume that Special T Travels will reimburse independently purchased travel arrangements if a trip is changed or cancelled. 9. Passports, Visas and Entry Requirements Each traveller is responsible for ensuring they possess the passports, visas, permits and other documentation required for their destination and circumstances. Travellers are also responsible for determining and complying with applicable entry, exit, health and documentation requirements. Special T Travels may provide general travel information as a convenience, but the traveller remains responsible for verifying current requirements with appropriate official authorities. Failure to obtain required documentation does not entitle a traveller to a refund. 10. Travel Insurance Travel insurance is strongly recommended. Travellers should consider coverage for trip cancellation and interruption, emergency medical treatment, evacuation, baggage, travel delays and other appropriate risks. It is the traveller's responsibility to understand the coverage, exclusions and limitations of any policy purchased. 11. Health and Fitness Travellers are responsible for determining whether they are physically and medically able to participate in the activities included in their trip. Travellers should disclose information specifically requested by Special T Travels where it is reasonably necessary to facilitate the trip or address dietary, accessibility or emergency considerations. Special T Travels cannot guarantee that every dietary, accessibility or medical request can be accommodated. 12. Traveller Conduct Travellers are expected to behave respectfully toward other travellers, Special T Travels representatives, suppliers, local communities and property. Special T Travels may remove a traveller from a trip where their behaviour creates a material safety risk, seriously disrupts the trip, involves harassment, violence, illegal activity, or materially interferes with other participants' reasonable enjoyment of the trip. Where a traveller is removed for such conduct, Special T Travels is not responsible for the traveller's resulting accommodation, transportation, flight or other expenses, and refunds are not guaranteed except where required by applicable law. 13. Personal Responsibility Travellers remain responsible for their own decisions and personal belongings while travelling. Participation in travel and recreational activities involves risks that cannot be completely eliminated. Travellers are expected to follow reasonable safety instructions provided by Special T Travels and activity providers. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited. 14. Photography and Social Media Special T Travels may take photographs or video during hosted trips. Where images of identifiable travellers are intended for promotional or commercial use, Special T Travels will obtain any consent required by applicable law. Travellers may advise Special T Travels if they do not wish to participate in promotional photography. 15. Pricing Prices are displayed in the currency identified on the applicable trip or service page. Special T Travels may correct genuine pricing or typographical errors before a booking is confirmed. Once a booking has been confirmed and the deposit received, the applicable confirmed price will govern except for changes expressly permitted by these Terms or required by law. 16. Chargebacks and Payment Disputes Travellers should contact Special T Travels promptly if they believe a payment has been processed incorrectly or if they have a concern regarding a refund. Nothing in these Terms prevents a traveller from exercising legitimate rights available through their payment provider or applicable law. Knowingly making a false or fraudulent payment dispute may result in Special T Travels providing relevant booking, acceptance and payment records to the payment provider. 17. Privacy Personal information is handled in accordance with the Special T Travels Privacy Policy. 18. Governing Law These Terms are governed by the laws applicable in the Province of Alberta and the federal laws of Canada applicable therein, subject to any mandatory consumer-protection or other laws that apply to the traveller. 19. Changes to These Terms Special T Travels may update these Terms from time to time. Changes will be identified by an updated version and effective date. A traveller's booking will retain a record of the applicable legal-document versions accepted in connection with that booking where the website provides that functionality.
